Purchase and statutory food terms for Brews
1. Direct WhatsApp Ordering & Order Confirmation
All orders placed through this web platform are finalised and confirmed directly via WhatsApp with our bakery team.
Upon receiving your order, we confirm your requested delivery or collection date and provide our banking details for EFT payment.
Your order is scheduled on our baking sheet once payment confirmation is received.
2. Consumer Protection Act (CPA) & Perishable Goods Exclusion
In accordance with Section 20(3)(a) of the Consumer Protection Act No. 68 of 2008 (CPA), freshly baked perishable foodstuffs cannot be returned or refunded once safely delivered due to public health and hygiene regulations.
However, if any item is defective, spoilt, or damaged upon delivery, you are entitled under Section 56 of the CPA to an immediate replacement or full refund upon notifying us within 4 hours.
3. Food Safety & Allergen Transparency (Act 54 of 1972)
All Brews waffles are prepared in accordance with Regulation R638 of South Africa's Foodstuffs, Cosmetics and Disinfectants Act.
Allergen Notice: Our waffles contain Wheat (Gluten), Dairy (Pure Butter, Milk), Eggs, and Soy lecithin. Products are prepared in a kitchen that handles nuts.
4. Free Kitchen Collection
Customers selecting 'Free Kitchen Collection' may collect their fresh order from Brews Bakery Kitchen: Ballito, KZN during confirmed hours.
5. Governing Law
These terms are governed by the laws of the Republic of South Africa. Legal matters fall under the jurisdiction of the Magistrate's Court of KwaDukuza / Ballito.
